Terms, privacy, disclaimers, and refunds

1. Agreement and eligibility

These Terms of Use, the Privacy Notice, and the Refund Policy form a binding agreement between you and 5280 Fitness Consulting, doing business as Blue Collar Money (“Blue Collar Money,” “we,” “us,” or “our”). By checking the consent box, purchasing, creating an account, or using the service, you confirm that you have read and agree to this agreement. If you do not agree, do not purchase or use the service.

You must be at least 18 years old, legally able to enter a contract, and using the service for a personal or household purpose in the United States. If you use the service for a household, you represent that you have permission to enter and share information about other household members. You are responsible for complying with laws that apply where you live.

2. Purchase, license, and delivery

Blue Collar Money is a digital educational tool for organizing household information, modeling possible cash-flow outcomes, and learning a repeatable money-management process. The advertised $29 founding-family price is a one-time payment in U.S. dollars, plus any tax that must legally be collected. It is not a subscription and does not authorize recurring charges. Payment is processed by Stripe. Digital access is ordinarily delivered after Stripe confirms payment.

Your purchase grants one personal, limited, revocable, nonexclusive, nontransferable household license to use the founding-family edition. You may use it with members of your household, but you may not resell, rent, sublicense, publicly distribute, or commercially exploit it. Improvements made generally available to the founding-family edition are included while that edition remains offered and supported. “Lifetime,” where used, means the supported life of this edition—not your lifetime, our lifetime, or a promise of perpetual hosting. We may change or discontinue features, but we will not convert this one-time purchase into a recurring charge without your separate express consent.

3. Accounts and acceptable use

Use the same email for purchase and account creation so access can be verified. You are responsible for accurate account information, protecting credentials and access links, restricting access to your devices and backups, and notifying us promptly of suspected unauthorized use. Do not share an account outside your household.

You may not copy or republish protected content except for your household's ordinary use; resell, sublicense, scrape, reverse engineer, bypass access controls, probe security, introduce malicious code, overload the service, impersonate another person, infringe rights, or use the service unlawfully. We may investigate, restrict, suspend, or terminate access when reasonably necessary to address fraud, abuse, security threats, chargebacks, legal requirements, or a material breach. Where practical, we will provide notice and a reasonable opportunity to cure.

4. Financial and educational disclaimer

Blue Collar Money provides general education and mathematical estimates based on information you enter. It does not provide individualized financial planning, investment, tax, legal, accounting, insurance, credit-repair, mortgage, or lending advice; recommend or broker financial products; monitor an account; or act as a fiduciary. No result, savings amount, debt payoff date, credit outcome, investment return, or household improvement is guaranteed.

Projections use assumptions such as income, timing, interest rates, bills, and contribution amounts. Real balances can differ because of taxes, fees, compounding conventions, missed or early transactions, market losses, variable work, inaccurate entries, and events the tool does not know about. Verify figures against bank, card, loan, payroll, tax, and investment records before acting. Consult an appropriately licensed professional for important decisions.

The service is not an emergency service and does not monitor deadlines, balances, overdrafts, fraud, credit reports, markets, or accounts. Do not delay contacting a creditor, financial institution, government agency, attorney, tax professional, licensed financial professional, or emergency service because of information shown here.

5. AI analysis disclaimer

AI responses are generated text, not professional advice. They may misunderstand a question, omit facts, make calculation or reasoning errors, or produce outdated, biased, or inaccurate information. Do not rely on AI alone for tax filings, investments, borrowing, insurance, benefits, legal rights, or urgent financial decisions.

When generative analysis is enabled and you press “Analyze our numbers,” your question and the financial summary identified in the request are sent through our server to OpenAI. We request that OpenAI not persist application state by setting store: false, and API data is not used to train OpenAI models unless the account owner separately opts in. OpenAI may nevertheless retain prompts, responses, and related metadata in abuse-monitoring logs for up to 30 days by default, or longer when legally required or reasonably necessary to protect services or third parties. Do not submit names, account numbers, Social Security numbers, card numbers, health information, passwords, or other details that are not needed for the analysis.

6. Privacy notice: scope and categories

This Privacy Notice explains the personal data Blue Collar Money controls through the website and support channel. It does not control information processed independently under Stripe, Supabase, OpenAI, Vercel, an email provider, your browser, your device, or a service you use to share a partner link or backup.

Household content stored on your device: Profiles, partner names, income, budgets, transactions you enter, expenses, bills, debts, credit utilization, investments, goals, emergency savings, progress, commitments, and settings are normally stored in your browser's local storage—not in a Blue Collar Money customer database. Clearing site data, changing browsers or devices, using private browsing, or losing a device can erase that content.

Purchase, consent, and access data: We and Stripe process the name and email you provide, price and currency, payment and refund status, transaction and checkout identifiers, timestamps, purchase-product information, and a record of the legal-policy version and acceptance time. Stripe processes card and billing information under its own privacy notice; Blue Collar Money does not receive or store your full card number or card security code.

Account and onboarding data: Supabase processes identifiers, email addresses, password verifiers and authentication factors, session information, device/browser information, and security events. Blue Collar Money does not receive your plaintext password. If you complete onboarding, the household name, work type, primary goal, lifecycle status, and checkout-session identifier may be stored in Stripe customer metadata to support access and customer service.

AI data: If generative analysis is enabled and you request it, we process the question and the household and financial summary sent with that request. The categories may include income, expenses, bills, debt totals and utilization, investments, savings, goals, net worth estimates, and safe-to-spend estimates. The service is designed to send summary numbers rather than account credentials or transaction-provider access.

Support and communications: We receive your email address, message, and anything you choose to attach, such as a redacted paycheck image. Remove Social Security numbers, bank and card numbers, passwords, health information, and unrelated household-member information before sending.

Optional guide and marketing email data: If you ask for the free safety guide and consent to follow-up, we process your email address, consent date, broad Safety Check result (safe, tight, or risk), referring campaign information, and engagement or delivery events supplied by our email provider. We do not receive or store the household dollar amounts entered into the free Safety Check. Lead records may be maintained in Stripe customer records and sent to an email or customer-relationship provider through a secure automation.

Technical, analytics, and performance data: We and our hosting, security, analytics, performance, and authentication providers may process IP address, device and browser type, operating system, requested pages, referring page, campaign tags, timestamps, cookie or session identifiers, approximate location derived from IP, broad product events such as Safety Check completion or checkout start, performance measurements, diagnostic logs, and security events. We use Vercel's first-party Web Analytics and Speed Insights to understand traffic and reliability. We do not send household dollar amounts through those tools and do not currently use third-party advertising pixels.

7. Sources, purposes, and legal grounds

We collect data directly from you, from your browser and device, and from providers such as Stripe and Supabase. We use it to provide and authenticate access; create and service transactions; document consent; process refunds; respond to support and privacy requests; protect accounts and the service; detect fraud and abuse; troubleshoot and improve reliability; enforce this agreement; comply with tax, accounting, legal, and regulatory obligations; and carry out a transaction or business transfer.

Where a law requires a legal basis, processing is based on performing our contract with you, our legitimate interests in operating and securing the service, compliance with law, or consent where specifically requested. You may withdraw consent for future optional processing, but withdrawal does not make earlier lawful processing unlawful or eliminate records we must retain.

Marketing email is optional and is not required to use the Safety Check or purchase the product. You may unsubscribe through the link in a marketing email or by contacting support. Transactional messages about a purchase, access, security, support request, refund, or material policy change may still be sent when permitted by law.

8. Disclosures, sale, advertising, and profiling

We disclose data only to service providers and contractors that help operate the product; professional advisers; a buyer or successor in a merger, financing, reorganization, or sale; authorities or other parties when reasonably necessary to comply with law or protect rights, safety, and security; and recipients you direct, such as a household partner.

Relevant provider categories include payment, customer records, and fraud prevention (Stripe), authentication and account-session infrastructure (Supabase), hosting and security (Vercel), optional AI processing (OpenAI), automation, and email/support providers. We do not sell personal data for money, share personal data for cross-context behavioral advertising, use personal data for targeted advertising, or use it to make legal or similarly significant decisions through profiling. We do not offer a financial incentive for personal data. If these practices change, we will update this notice and provide legally required choices before the new processing begins.

9. Partner links, backups, cookies, and device controls

A partner link can contain a household plan encoded in the URL fragment. Fragments are designed to remain in the browser rather than being sent in the ordinary web request, but anyone who receives the complete link may be able to read and import the information. Messaging, email, browser, device, security, and link-preview tools may also handle the link. Share it only through a trusted channel and treat it like a private financial document.

Downloaded JSON backups contain the household plan in readable, unencrypted form. Calendar exports can reveal household routines. Store exports securely and delete copies you no longer need. Blue Collar Money cannot retrieve, decrypt, remotely delete, or restore a partner link or backup once you control or share it.

The service uses local storage and cookies or similar technology that are necessary to remember the plan, maintain authentication, prevent fraud, and confirm purchase access. We do not currently use advertising cookies. Blocking or clearing necessary storage can sign you out, erase device-stored content, or break access. Browser privacy controls govern device storage; provider cookies are also subject to the applicable provider's notice.

10. Retention and security

Device-stored household content remains until you edit it, reset the dashboard, clear site data, or remove it through browser/device controls. We retain purchase, consent, tax, refund, fraud-prevention, and accounting records for the period reasonably necessary for those purposes and applicable limitation or legal periods. Support records are kept only as long as reasonably needed to resolve the request, improve service, establish or defend claims, or meet legal obligations. Authentication, hosting, payment, and AI providers apply their own retention schedules. We delete or de-identify data when it is no longer reasonably necessary, unless retention is required or permitted by law.

We use reasonable administrative, technical, and organizational safeguards appropriate to the service, including secure HTTPS transport, restricted provider access, signed Stripe webhook verification, secure authentication services, and data minimization. No device, transmission, provider, or online service is perfectly secure. You are responsible for device security and for safeguarding credentials, links, downloads, and information you choose to send.

11. Your privacy choices and state rights

You can edit device-stored information inside the dashboard, export a backup, or delete it by resetting the dashboard or clearing site data. You can change your password through the account-recovery flow. To request access, confirmation, correction, deletion, or a portable copy of personal data we control outside your device, email support@bluecollarmoney.app from the purchase or account email and write “Privacy request” in the subject. Describe the request and the state where you reside. We will verify identity and authority in a proportionate manner and respond within the period required by applicable law. We will not discriminate against you for exercising a privacy right.

Colorado residents, where the Colorado Privacy Act applies, may have rights to access, correct, delete, and obtain portable data, and to opt out of sale, targeted advertising, and certain profiling. Because we do not currently engage in those opt-out activities, there is no opt-out switch to operate. We will respond to a verified Colorado request within 45 days as required, subject to one permitted 45-day extension with notice and an explanation. If we deny a Colorado request, you may appeal by replying with “Privacy appeal”; we will respond and explain any available complaint route. Authorized agents may submit requests where law permits, subject to verification. Residents of California and other states may have additional rights where their laws apply. Rights are subject to statutory exceptions, and we may retain records required for security, fraud prevention, transactions, taxes, legal compliance, or claims.

12. Children and U.S. audience

The service is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children under 13. Do not enter a child's name or other identifying information into household fields, AI questions, partner links, backups, or support messages. If you believe a child provided personal information, contact us so we can investigate and delete it where required. The service is operated from and directed to users in the United States.

13. 30-day payday-cycle refund policy

You may request a full refund of the product purchase price for any reason within 30 calendar days after the purchase timestamp. The “one payday-cycle” language describes how we encourage you to evaluate the product; completing a payday cycle, providing an explanation, sending financial documents, or proving dissatisfaction is not required.

To request a refund, email support@bluecollarmoney.app from the purchase email with the subject “Refund request.” Include the purchase email and, if readily available, the Stripe receipt or transaction identifier. Do not send card or bank numbers. We will acknowledge the request and, for an eligible purchase, submit a full refund to the original payment method. Stripe and the card issuer or financial institution control when the credit appears. Access may be disabled after a full refund. This voluntary policy is in addition to, and does not limit, refund, cancellation, or remedy rights that cannot legally be waived.

Requests received after 30 days are reviewed under non-waivable law and, otherwise, at our discretion. Duplicate charges, unauthorized transactions, failure to deliver paid access, or a material service defect should be reported promptly and may qualify for correction or refund independently of this voluntary policy. Promotional discounts reduce the amount paid and therefore the amount refunded.

14. Founding-family help

For 30 days after purchase, founding families may email one household question or a paycheck image for product guidance. Remove unnecessary sensitive information before sending. Replies are educational guidance, not personalized professional advice. The stated two-business-day response time is a service goal, not a guarantee.

15. Ownership, user content, and feedback

Blue Collar Money's software, design, text, graphics, and methods are owned by or licensed to 5280 Fitness Consulting and protected by applicable law. Your household data remains yours. If you send product feedback, you allow us to use it without payment or restriction, but we will not publicly identify you without permission.

You grant us only the limited rights reasonably necessary to process content you intentionally send to our servers or providers to operate, secure, support, and improve the service. You represent that you have the right to submit that content and that doing so does not violate another person's privacy or rights.

16. Third-party services and links

The service depends on third-party services and may link to third-party websites. We do not control their availability, content, security, or independent practices. Review their terms and privacy notices: Stripe for payments, Supabase for authentication, OpenAI for optional AI analysis, and Vercel for hosting. A provider outage or policy change may affect features.

17. Availability, warranties, and liability

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties and do not promise uninterrupted access, error-free calculations, data recovery, or fitness for a particular purpose. To the fullest extent permitted by law, 5280 Fitness Consulting and its providers will not be liable for indirect, special, incidental, consequential, or punitive damages, lost profits, lost data, financial losses, or decisions made from the service. Our aggregate liability for a claim related to the service will not exceed the amount you paid for it. These limits do not apply where prohibited by law.

18. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless 5280 Fitness Consulting and its owners, personnel, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the service, your intentional misconduct, content you submit or share without the required rights or permission, or your material violation of this agreement. This section does not require you to indemnify anyone for their own negligence, willful misconduct, or violation of law where such a limitation is prohibited.

19. Disputes and governing law

Before filing a lawsuit, you and Blue Collar Money agree to make a good-faith attempt to resolve the dispute for at least 30 days after written notice. Send notice to support@bluecollarmoney.app with the subject “Legal dispute notice” and describe the issue, the requested resolution, and the purchase email. This informal step does not prevent either party from seeking urgent injunctive relief or filing an eligible claim in small-claims court, and it does not extend a legal deadline unless the law permits.

Colorado law governs this agreement, without regard to conflict-of-law rules and without overriding consumer rights that cannot be waived. Subject to any non-waivable right to bring a claim elsewhere, state and federal courts located in Colorado have exclusive jurisdiction, and the parties consent to venue there. Nothing here requires arbitration or waives the right to participate in a class action.

20. Accessibility statement

We aim to make Blue Collar Money usable with keyboard navigation, readable contrast, meaningful labels, and responsive layouts. If a disability prevents you from using a feature or accessing information, email support@bluecollarmoney.app. Tell us the page, the barrier, and the format that would help; we will make a reasonable effort to provide access or an alternative.

21. Changes, assignment, severability, and entire agreement

We may update this agreement or the service. Material changes will be posted with a new effective date and, when appropriate, additional notice. Changes apply prospectively unless law permits otherwise. If a change requires consent, we will request it. Continued use after the effective date of another change means acceptance.

You may not assign this agreement or license without our written consent. We may assign it as part of a merger, reorganization, financing, asset transfer, or sale. Delay in enforcing a provision is not a waiver. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue. Headings are for convenience. Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnity, disputes, and accrued payment obligations—survive. This agreement and policies expressly incorporated into it are the entire agreement about the service and replace earlier representations on the same subject.

You may also reply to the Stripe receipt for purchase support.
